DAB Submits Proposals on improving laws on Sexual Offences

The DAB today submitted its views to the Security Bureau in full support of the consultation paper on improving laws on Sexual Offences.

 

LegCo Member Elizabeth Quat said that the current sexual offences legislation, which has been in place for decades, is no longer adequate to address new types of offences emerging today. She noted that the reform represents the most comprehensive review since 1956 and will significantly enhance protection for women, children and vulnerable groups.

 

Quat endorsed the proposal to establish a statutory definition of "consent", and also welcomed the extension of the scope of the offence of rape to cover non-penile penetration and same-sex offences, reinforcing the principle of protection regardless of gender.

 

Regarding sexual offences against children, Quat supported the proposal to standardize the age of consent at 16, describing it as necessary and long overdue. However, she expressed concern that the consultation paper does not address the issue of deepfake‑generated sexual content that is created but not published. She urged the Government to examine this gap to ensure the law keeps pace with evolving technology.
